Question by Seaway: How do statutory rape laws apply in a state you don't live in?

I'm 19 and my girlfriend is 17. We live in two separate states and are both consenting adults in either state. We are planning on going to California on a sort of vacation, but the age of consent is 18 there. I highly doubt we would get caught having sex (hotel only), since her parents aren't going to be there, but if we were, how would she and I be prosecuted since neither of us live in California?

You get prosecuted in the jurisdiction you commit the crime. Since you are from out of state, they might just keep you there until your hearing for bail - as you would be a flight risk.
